1. Definitions
In these terms and conditions, the following definitions apply:
- Seller: Wijnatelier Eikenrode, owner Hans Snoeren, hereinafter referred to as "Wijnatelier Eikenrode" or "we".
- Customer: the natural person or legal entity entering into an agreement with Wijnatelier Eikenrode, hereinafter referred to as "you" or "the customer".
- Wijnstudie App: the digital web application (Progressive Web App) developed by Wijnatelier Eikenrode, intended as a study companion in preparation for the WSET Level 3 exam.
- Agreement: the agreement between Wijnatelier Eikenrode and the customer regarding the purchase of and access to the Wijnstudie App.
- Digital content: all data produced and delivered in digital form, including the Wijnstudie App, the practice questions, study materials and associated functionalities.
- Early Bird: the pre-registration offer at a reduced rate, available prior to or around the official launch date.
2. Applicability
These terms and conditions apply to every offer made by Wijnatelier Eikenrode relating to the Wijnstudie App and to every agreement concluded between Wijnatelier Eikenrode and the customer.
By placing an order or using the Wijnstudie App, you agree to these terms and conditions. We recommend that you read these terms and conditions carefully before placing an order.
Deviations from these terms and conditions are only valid if they have been confirmed in writing and explicitly by Wijnatelier Eikenrode.
3. The offer and the agreement
3.1 Product description
The Wijnstudie App is a digital product in the form of a Progressive Web App (PWA), designed as a study companion in preparation for the WSET Level 3 exam. The app contains practice questions, multiple practice modes, progress tracking and spaced repetition functionality.
3.2 Pre-registration (Early Bird)
Prior to the official launch on 1 September 2026, Wijnatelier Eikenrode offers a pre-registration period at a reduced rate (the Early Bird rate). By registering during the pre-registration period, you enter into an agreement for the purchase of the Wijnstudie App at the then-applicable Early Bird rate.
3.3 Formation of the agreement
The agreement is formed at the moment you fully complete and submit the order form, and payment has been received by Wijnatelier Eikenrode. You will receive a confirmation by e-mail.
3.4 Lifetime access
Upon payment, you will receive lifetime access to the Wijnstudie App. "Lifetime" means: for as long as Wijnatelier Eikenrode actively maintains and makes the Wijnstudie App available. Should Wijnatelier Eikenrode decide to permanently discontinue the app, you will be notified at least 6 months in advance by e-mail.
4. Price and payment
4.1 Prices
The current price of the Wijnstudie App and the accompanying study guides is stated on the order page and is shown to you before you complete your order. During the pre-registration period (Early Bird), a reduced rate applies compared to the regular rate that will take effect after the launch.
All prices stated on the order page include VAT, unless explicitly stated otherwise. No recurring costs or subscription fees are associated with the one-time purchase of the Wijnstudie App.
4.2 Payment
Payment is made via the payment methods available on the order form on the Wijnstudie App landing page. Payment must be made in full before access to the app is granted.
4.3 Invoicing
With your order, you will receive a digital payment confirmation by e-mail. If you require an invoice, you can indicate this when placing your order. To issue an invoice, we are legally required to have the following information:
- Full name or company name;
- Full address (street, house number, postal code, city, country).
For business purchases, you must also provide your VAT number (VAT ID) and Chamber of Commerce registration number. Wijnatelier Eikenrode is legally obliged to include this information on the invoice. All invoicing data is used exclusively for invoicing purposes and is retained in accordance with the fiscal retention obligation of 7 years.
4.4 Price changes
Wijnatelier Eikenrode reserves the right to adjust prices. Price changes do not affect orders that have already been placed and paid for.
5. Delivery
5.1 Digital delivery
The Wijnstudie App is a digital product. Delivery takes place by providing access to the app via a personal link and login credentials, sent by e-mail to the e-mail address you provided.
5.2 Delivery for pre-registrations
If you registered during the Early Bird period before the launch date (1 September 2026), you will receive your access credentials by e-mail on or around the launch date. Minor delays in delivery do not entitle you to dissolution of the agreement or a refund, unless the delay exceeds 30 days.
5.3 Requirements
To use the Wijnstudie App, you need a device with a modern web browser and an internet connection. After installation as a PWA, the app can also be used offline. Wijnatelier Eikenrode is not responsible for technical issues arising from your equipment or internet connection.
6. Right of withdrawal
6.1 Cooling-off period
Under European consumer protection legislation, as a consumer you have the right to cancel the agreement for the purchase of a digital product within 14 days of concluding the agreement without giving any reason (right of withdrawal).
6.2 Exception for digital content
In accordance with artikel 6:230p lid 3 of the Dutch Civil Code (Burgerlijk Wetboek), the right of withdrawal may lapse once the delivery of digital content has begun, provided that:
- You have given your express prior consent to begin the performance of the agreement within the cooling-off period;
- You have declared that you thereby waive your right of withdrawal.
During the order process, you will be asked to grant this consent. If you grant this consent, a refund is no longer possible after gaining access to the app.
6.3 Pre-registration
If you registered during the Early Bird period and the app has not yet been launched, you may cancel your order free of charge and receive a full refund, provided you submit this request before you have actually gained access to the app.
6.4 Exercising your right of withdrawal
To exercise your right of withdrawal, send an unambiguous statement by e-mail to wijnatelier@eikenrode.nl. Upon receipt of your withdrawal statement, Wijnatelier Eikenrode will refund the purchase amount within 14 days using the same payment method you used for the purchase.
7. Liability
7.1 Limited liability
The Wijnstudie App is a tool to support your study for the WSET Level 3 exam. Wijnatelier Eikenrode does not guarantee in any way that using the app will result in passing the exam. Exam success depends on many factors, including your own effort, background knowledge and exam conditions.
7.2 Content accuracy
Wijnatelier Eikenrode strives for accurate and up-to-date content but cannot guarantee that all information in the app is at all times complete, correct or current. The content of the app does not replace the official WSET course material.
7.3 Maximum liability
The total liability of Wijnatelier Eikenrode is in all cases limited to the amount you paid for the Wijnstudie App. Wijnatelier Eikenrode is not liable for indirect damages, consequential damages, lost profits or missed opportunities.
7.4 Availability
Wijnatelier Eikenrode strives for high availability of the app but cannot guarantee uninterrupted access. Maintenance, updates or technical disruptions may temporarily limit availability.
8. Intellectual property
8.1 Ownership rights
All intellectual property rights to the Wijnstudie App, including but not limited to the source code, design, texts, questions, images and other content, belong to Wijnatelier Eikenrode or its licensors.
8.2 Right of use
Upon payment, you acquire a personal, non-transferable and non-exclusive right to use the Wijnstudie App. This means that you may use the app exclusively for your own study purposes.
8.3 Restrictions
It is not permitted to:
- Copy, reproduce, distribute or make public the content of the app in whole or in part;
- Use the app or its content for commercial purposes;
- Share your account credentials with third parties or grant third parties access to the app;
- Circumvent or attempt to circumvent the technical security measures of the app;
- Reverse-engineer, decompile or disassemble the source code of the app.
8.4 Study guides (Quick Guide and Core Guide)
In addition to the Wijnstudie App, Wijnatelier Eikenrode offers personalised PDF study guides for preparation for the WSET Level 3 exam: the Quick Guide (a concise summary per chapter) and the Core Guide (a comprehensive study guide with summaries, maps and background). These are independent products of Wijnatelier Eikenrode.
All intellectual property rights, including copyright, in the Quick Guide and the Core Guide and their content, including but not limited to the texts, summaries, maps, images, questions and design, belong to Wijnatelier Eikenrode or its licensors.
Upon payment or delivery respectively, you obtain a personal, non-transferable and non-exclusive right of use to the relevant study guide, solely for your own study purposes. Each delivered copy bears your name and e-mail address. It is not permitted to copy, reproduce, distribute, make public, make available to third parties or use the Quick Guide or the Core Guide, in whole or in part, for commercial purposes.
The other provisions of this Article 8 apply mutatis mutandis to the Quick Guide and the Core Guide.
9. WSET Disclaimer
The Wijnstudie App is an independent study platform for preparation for the Level 3 wine exam. The app is not affiliated with, endorsed by, or in any way connected to the Wine & Spirit Education Trust (WSET®).
WSET® is a registered trademark of the Wine & Spirit Education Trust. The use of the name WSET in the Wijnstudie App and on this website serves solely as a reference to the exam programme for which the app prepares and does not imply endorsement, collaboration or affiliation.
The content of the app has been independently developed by Wijnatelier Eikenrode and is based on generally available knowledge about viticulture, vinification, wine regions and tasting technique. Wijnatelier Eikenrode does not guarantee that the content of the app fully corresponds to the current WSET curriculum and is not responsible for any changes to the WSET exam programme.
10. Privacy and data protection (GDPR)
Wijnatelier Eikenrode attaches great importance to the protection of your personal data and processes your data in accordance with the General Data Protection Regulation (GDPR).
10.1 What data is collected
In the context of the Wijnstudie App, we collect the following personal data:
- Name: for creating your personal account.
- E-mail address: for sending login credentials, communication about your order and any service messages.
- App usage data: your progress, scores and study statistics are stored on your device and, linked to your account, synchronised via our secure server, so that you can use the app on multiple devices and your progress is preserved. This data is used solely to provide the app to you and is not shared with third parties for commercial purposes.
10.2 Purpose of processing
Your data is processed exclusively for the following purposes:
- The performance of the agreement: providing access to the Wijnstudie App.
- Maintaining contact regarding your order and account.
10.3 Legal basis
The processing of your personal data is based on the performance of the agreement (Article 6(1)(b) GDPR). For any additional processing, we will request your express consent.
10.4 Retention period
Your personal data will be retained for as long as you have an active account with the Wijnstudie App. After deletion of your account, your data will be removed within 30 days, with the exception of data that we are required to retain for a longer period due to legal obligations (such as invoicing data, which is retained for 7 years in accordance with the fiscal retention obligation).
10.5 Data subject rights
Under the GDPR, you have the following rights with respect to your personal data:
- Right of access: you can request which personal data we process about you.
- Right to rectification: you can request the correction of inaccurate or incomplete data.
- Right to erasure: you can request the deletion of your personal data ("right to be forgotten").
- Right to data portability: you can request to receive your data in a structured, commonly used and machine-readable format.
- Right to restriction: you can request the restriction of the processing of your data.
- Right to object: you can object to the processing of your data.
10.6 No sale to third parties
Wijnatelier Eikenrode does not sell, rent or share your personal data with third parties for commercial purposes. Data is only shared with third parties insofar as this is necessary for the performance of the agreement (for example, a payment provider), and always under appropriate data processing agreements.
10.7 Security
Wijnatelier Eikenrode takes appropriate technical and organisational measures to protect your personal data against unauthorised access, loss or misuse.
10.8 Contact for privacy requests
For all questions, requests or complaints regarding your privacy, you can contact us at wijnatelier@eikenrode.nl. We will respond to your request within 30 days at the latest. If you are not satisfied with how your request has been handled, you have the right to file a complaint with the Dutch Data Protection Authority (Autoriteit Persoonsgegevens, www.autoriteitpersoonsgegevens.nl).
11. Amendments to these terms
Wijnatelier Eikenrode reserves the right to amend these terms and conditions. Amendments will be communicated to you by e-mail at least 30 days before they take effect. If you do not agree with the amended terms, you may terminate your account.

12. Applicable law and disputes
12.1 Applicable law
These terms and conditions and all agreements between Wijnatelier Eikenrode and the customer are governed exclusively by the laws of the Netherlands.
12.2 Dispute resolution
In the event of disputes, we will first endeavour to reach a resolution through mutual consultation. Should this not be possible, the dispute will be submitted to the competent court in the judicial district in which Wijnatelier Eikenrode is established.
12.3 Out-of-court dispute resolution
The European Commission's Online Dispute Resolution (ODR) platform has been closed and is no longer available. If we are unable to resolve a dispute together, you may submit your dispute to the competent court as referred to in Article 12.2.
